Terms of service
Last updated: October 19, 2026
These Terms of Service ("Terms") are a binding agreement between you and Great Call Athletics LLC ("Great Call Athletics," "we," "us," or "our"). They govern your access to and use of greatcallathletics.com, customer accounts, communications, content, products, and related services (collectively, the "Services").
Please read these Terms carefully. Section 20 contains a binding individual arbitration agreement and class-action waiver that affect your legal rights. You may opt out of arbitration as explained in Section 20.
By accessing or using the Services, creating an account, or placing an order, you agree to these Terms and the policies incorporated into them. If you do not agree, do not use the Services.
1. Eligibility and authority
You must be at least the age of majority in your state or province of residence to enter into these Terms. If you permit a minor to use the Services, you are responsible for the minor's activity and purchases to the extent permitted by law. If you use the Services for a business, team, school, league, government agency, or other organization, you represent that you have authority to bind that organization, and "you" includes that organization.
2. Accounts and information
You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your account credentials and for activity under your account. You may not impersonate another person, create an account through unauthorized automated means, or use another person's payment method or information without permission. Notify us promptly at orders@greatcallathletics.com if you suspect unauthorized activity.
3. Products, descriptions, and availability
We try to describe and display products accurately, but colors, dimensions, packaging, specifications, model-year details, availability, and other information may vary or contain errors. Images may include props or accessories not included with the product. Product information supplied by manufacturers or other third parties may change without notice. You are responsible for reviewing the product description, compatibility, sizing, safety information, and manufacturer instructions before purchase and use.
All products and offers are subject to availability. We may limit quantities, discontinue products, restrict sales by person, account, household, address, region, or jurisdiction, and refuse orders that appear fraudulent, abusive, unauthorized, intended for prohibited resale, or otherwise inconsistent with these Terms. Any offer is void where prohibited.
4. Orders and acceptance
Your order is an offer to purchase. An order confirmation, payment authorization, or temporary charge does not mean we have accepted the order. We accept an order when we issue a shipment confirmation or otherwise expressly confirm acceptance. We reserve the right to refuse, limit or cancel any order, in whole or in part, for any reason in our sole discretion, with or without prior notice or explanation, at any time before the order ships. Reasons may include, without limitation, inventory shortages, supplier restrictions, suspected fraud, address or payment problems, pricing, shipping or description errors, or quantity limits. If we cancel after collecting payment, we will refund the amount collected for the canceled items.
We may require additional verification before accepting or fulfilling an order. You authorize us and our providers to use the information you submit to verify identity, payment, shipping, and order legitimacy.
5. Prices, payment, taxes, and errors
Prices, promotions, availability, and product details may change without notice before order acceptance. Unless stated otherwise, prices are in U.S. dollars and exclude taxes, duties, shipping, and other charges. You are responsible for charges displayed at checkout and for duties, taxes, brokerage fees, or other amounts imposed by authorities or carriers, except where law requires otherwise.
You represent that you are authorized to use the payment method submitted and authorize us and our payment providers to charge all amounts due. We may correct errors and reject or cancel affected orders even after submission. If a correct price is higher than the displayed price, we may contact you for approval before shipment or cancel and refund the order. Nothing in this section limits rights that cannot lawfully be waived.
If you believe a charge is incorrect, contact us promptly so we can investigate. This does not limit any lawful right to dispute a charge with your payment provider. Knowingly submitting a false chargeback, using unauthorized payment information, or retaining merchandise after obtaining an improper reversal may violate these Terms and applicable law.
6. Shipping, delivery, and international orders
Shipping options and charges depend on the products ordered and the delivery address and are shown at checkout before you place your order. Items may ship separately. Shipping charges may apply separately to different items. Shipping offers apply only to eligible items and do not waive shipping charges on other items in the same order. See our Shipping Policy for shipping eligibility, delivery estimates, and exclusions.
Shipping and delivery dates are estimates unless we expressly guarantee otherwise in writing. Delays may occur due to carrier performance, weather, supply constraints, address problems, customs, force majeure events, or other circumstances. Our Shipping Policy is incorporated into these Terms.
You are responsible for providing a complete and deliverable address and for reviewing it before checkout. Additional costs caused by an incorrect address, refused delivery, failure to collect a package, or an unauthorized reroute may be deducted from a refund or charged to you to the extent permitted by law. All orders ship FOB Origin: title and risk of loss pass to you when the order is handed to the carrier. Shipments carry only the standard carrier liability included with the shipping label or bill of lading, and no additional insurance is purchased unless you arrange it with us before the order ships, as described in our Shipping Policy. Shipping charges may include handling and do not necessarily reflect the actual carrier cost; the difference is not adjusted or refunded. For international orders, you are the importer of record unless stated otherwise and are responsible for local requirements and charges.
7. Returns, exchanges, refunds, and warranties
Returns, exchanges, and refunds are governed by our Refund Policy, which is incorporated into these Terms. Manufacturer warranties, when available, are provided by the manufacturer under its own terms. We may assist with a warranty request but do not control the manufacturer's decision or remedy.
8. Product use, fit, and safety
Sports, training, officiating, aquatic, diving, protective, and outdoor activities involve inherent risks of property damage, injury, disability, or death. Products must be selected, fitted, installed, maintained, inspected, and used in accordance with applicable laws, rules, standards, and manufacturer instructions. No product eliminates all risk. Product descriptions, sizing guidance, reviews, and customer support are general information and are not medical, safety, engineering, coaching, or other professional advice.
You are responsible for confirming that a product is appropriate for the intended user and activity, obtaining qualified instruction where appropriate, using required protective equipment, inspecting equipment before each use, and discontinuing use of damaged, recalled, expired, altered, or improperly fitting equipment. Do not modify a product in a way that could impair safety. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability arising from a defective product where applicable law provides otherwise.
9. Promotions, gift cards, and Best Price Promise
Promotions, discount codes, gifts with purchase, loyalty benefits, and gift cards may have additional terms and may not be combined unless expressly stated. We may modify or end a promotion prospectively and may cancel benefits obtained through error, fraud, abuse, or violation of its terms, subject to applicable law.
Best Price Promise
Found a lower price from an eligible retailer before checkout? Send us the live link. If the item qualifies, we may match the current retail item price.
To qualify, the lower price must be for the exact same item and variant, including brand, model, UPC or MPN, size, color, condition, and quantity. You must provide a link to the exact item and variant. The item must be new, authentic, in stock, available for immediate purchase, and listed by an eligible retailer.
The request must be brought to our attention before checkout. We do not apply price matches after an order is placed.
The Best Price Promise applies to the competitor's retail item price only. It does not include competitor coupons, promo codes, discounts, rebates, loyalty rewards, gift cards, store credit, membership pricing, bundles, volume discounts, shipping offers, taxes, duties, handling fees, delivery speed, free promotional items, financing terms, or warranty add-ons.
Price matches exclude marketplace or third-party sellers, unauthorized dealers, used, counterfeit, refurbished, open-box, demo, damaged, liquidation, auction, closeout, backorder, preorder, and obvious pricing-error listings. We may verify the listing and retailer and may approve, limit, or deny a request in our reasonable discretion.
10. Intellectual property
The Services, including site design, text, graphics, logos, photographs, videos, software, product compilations, and other content, are owned by or licensed to Great Call Athletics and are protected by intellectual-property and unfair-competition laws. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Services for personal or authorized internal business shopping purposes.
You may not copy, reproduce, modify, distribute, sell, license, scrape, data-mine, frame, mirror, reverse engineer, use to train an automated model, or commercially exploit any part of the Services except with our prior written permission or as permitted by nonwaivable law. Brand names and product marks owned by third parties remain the property of their respective owners. No license to any trademark is granted by implication.
11. Reviews, feedback, and user content
If you submit a review, photograph, video, comment, idea, question, or other content ("User Content"), you retain ownership of your content but grant Great Call Athletics a worldwide, nonexclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, adapt, translate, publish, display, distribute, and otherwise use that User Content in connection with operating, improving, and promoting our business and Services, subject to applicable law and our Privacy Policy.
You represent that you own or have permission to submit the User Content; it is truthful and based on your genuine experience where represented as a review; and it does not infringe intellectual-property, privacy, publicity, or other rights, contain unlawful or harmful material, or include confidential information. We may moderate or remove User Content in our discretion but have no obligation to do so. We do not claim ownership of unsolicited product ideas and are not obligated to keep them confidential, develop them, or compensate you.
12. Prohibited conduct
You may not use the Services to:
- violate law, regulations, sanctions, export controls, league rules, or the rights of others;
- commit fraud, submit false information, evade quantity limits, or make unauthorized purchases;
- interfere with security or operation, introduce malicious code, probe vulnerabilities, or gain unauthorized access;
- scrape, crawl, index, harvest, monitor, or extract data or content by automated means without written permission, except for ordinary search-engine indexing;
- spam, phish, impersonate, harass, threaten, defame, or discriminate;
- resell access to the Services or use the Services to build a competing product or data set; or
- assist another person in doing any of the above.
13. Third-party services and links
The Services may use or link to third-party services, payment methods, carriers, social networks, applications, or websites. Third parties may impose their own terms and privacy practices. We do not control and are not responsible for third-party services, content, availability, or actions. A link or integration does not imply endorsement.
14. Privacy
Our collection and use of personal information are described in our Privacy Policy. By using the Services, you acknowledge that you have reviewed that policy.
15. Communications
You agree that we may provide transaction, account, security, legal, and service communications electronically, including by email or through the Services. You are responsible for keeping your contact information current. If you separately consent to marketing email or SMS, consent is not a condition of purchase and you may opt out as described in the message. Message and data rates may apply to SMS. Opting out of marketing does not stop non-marketing communications about an existing transaction or account.
16. Suspension and termination
We may suspend or terminate access to the Services, refuse service, or cancel unaccepted orders if we reasonably believe you violated these Terms, created risk or potential legal exposure, engaged in fraud or abuse, or if needed to protect the Services or others. Provisions that by their nature should survive termination will survive, including payment obligations, intellectual-property provisions, disclaimers, limitations, indemnity, and dispute terms.
17. Disclaimer of warranties
To the fullest extent permitted by law, the Services and all information and content made available through them are provided "as is" and "as available." Great Call Athletics and its officers, members, employees, agents, affiliates, licensors, and service providers disclaim all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, quiet enjoyment, and any warranty arising from course of dealing or usage of trade.
We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components; that information will be complete, accurate, or current; or that any product will meet every user's expectations or eliminate risks inherent in an activity. Manufacturer warranties and any express written promises we make are not disclaimed to the extent they cannot lawfully be disclaimed.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, exclusions apply only to the maximum extent permitted by law.
18. Limitation of liability
To the fullest extent permitted by law, Great Call Athletics and its officers, members, employees, agents, affiliates, licensors, suppliers, and service providers will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages; loss of profits, revenue, goodwill, use, or data; business interruption; or cost of substitute goods or services arising out of or related to the Services, products, or these Terms, regardless of the theory of liability and even if advised that such damages were possible.
To the fullest extent permitted by law, the total aggregate liability of Great Call Athletics and the other released parties for all claims arising out of or relating to a product, the Services, or these Terms will not exceed the greater of (a) the amount you paid to Great Call Athletics for the product or transaction giving rise to the claim or (b) $100.
The limitations in this section do not apply to liability that cannot be limited by law, which may include liability for fraud, willful misconduct, gross negligence, certain personal injuries, or certain statutory consumer rights. Some jurisdictions do not allow particular limitations, so those limitations apply only to the maximum extent permitted by law.
19. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Great Call Athletics and its officers, members, employees, agents, affiliates, licensors, and service providers from third-party claims, liabilities, damages, judgments, losses, and reasonable costs and attorneys' fees arising from your unlawful misuse of the Services, your material breach of these Terms, your User Content, or your violation of another person's rights. This obligation does not apply to the extent a claim results from our own negligence, willful misconduct, or other conduct for which indemnification may not lawfully be required. We may control the defense and settlement of an indemnified claim, and you agree to cooperate.
20. Dispute resolution, individual arbitration, and class-action waiver
Please read this section carefully. It requires most disputes to be resolved by binding arbitration on an individual basis and waives jury-trial and class-action rights.
Informal resolution first
Before starting arbitration, you and Great Call Athletics agree to make a good-faith effort to resolve the dispute informally. The claimant must send a written notice describing the claimant's name and contact information, the relevant order or account, the facts and legal basis of the dispute, and the specific relief requested. Notices to us must be sent to orders@greatcallathletics.com with the subject "Legal Dispute Notice" and by mail to Great Call Athletics LLC, 761 Coates Avenue, Suite 70, Holbrook, NY 11741. We will send notices to your most recent account or order contact information. Neither party may begin arbitration until 30 days after a complete notice is received, except to seek urgent injunctive relief.
Agreement to arbitrate
Except for the exclusions below, you and Great Call Athletics agree that any dispute, claim, or controversy arising out of or relating to the Services, a product, an order, these Terms, or the relationship between us, including disputes about the formation, scope, enforceability, or interpretation of this arbitration agreement, will be resolved by final and binding individual arbitration. This agreement involves interstate commerce and is governed by the Federal Arbitration Act.
Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, available at adr.org, as modified by these Terms. The arbitrator may award the same individual remedies a court could award. The arbitration may be conducted by video, telephone, documents, or in person at a reasonably convenient location consistent with the AAA rules. Fees will be allocated under the AAA Consumer Arbitration Rules, except that we will pay amounts the law or those rules require us to pay. A court of competent jurisdiction may enter judgment on the award.
Excluded claims
Either party may bring an individual claim in small-claims court if it qualifies and remains there. Either party may seek temporary or preliminary injunctive relief in court to protect intellectual-property rights, confidential information, account security, or the integrity of the Services pending arbitration. Government agencies may enforce rights within their authority.
No class or representative proceedings
You and Great Call Athletics agree that each may bring claims only in an individual capacity, not as a plaintiff, claimant, or class member in a class, collective, consolidated, mass, private-attorney-general, or representative proceeding. The arbitrator may not combine claims of different people or preside over any class or representative proceeding. If a final decision holds that applicable law prevents enforcement of this paragraph as to a particular claim or remedy, only that claim or remedy will proceed in court after all arbitrable matters are resolved.
Thirty-day right to opt out
You may opt out of this arbitration agreement by sending a signed notice within 30 days after you first accept these Terms. The notice must include your full name, mailing address, email address used for the Services, and an unambiguous statement that you opt out of the arbitration agreement in the Great Call Athletics Terms of Service. Send it by email to orders@greatcallathletics.com with the subject "Arbitration Opt-Out" or by mail to Great Call Athletics LLC, 761 Coates Avenue, Suite 70, Holbrook, NY 11741. Opting out will not affect other Terms or your ability to use the Services.
21. Governing law and court venue
These Terms and any dispute not subject to arbitration are governed by the laws of the State of New York, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs Section 20. You and Great Call Athletics consent to the exclusive jurisdiction and venue of the state and federal courts located in Suffolk County, New York for disputes permitted to proceed in court. This choice of law and venue does not deprive you of protections that cannot be waived under the law of your residence.
22. Force majeure
We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, fire, epidemic, war, terrorism, civil unrest, labor disputes, transportation or supply-chain interruption, utility or communications failure, cyberattack, government action, carrier failure, or supplier failure. This section does not excuse payment obligations or limit rights that cannot be waived.
23. Changes to the Services or Terms
We may modify or discontinue all or part of the Services and may update these Terms from time to time. The updated date above identifies the latest version. Changes apply prospectively when posted unless a different date is stated. Where required by law, we will provide additional notice or obtain consent. Your continued use after the effective date means you accept the revised Terms. Changes to Section 20 will not apply to a dispute for which the parties had actual notice before the change was posted.
24. General provisions
These Terms and the policies expressly incorporated into them are the entire agreement between you and Great Call Athletics regarding the Services and supersede prior or contemporaneous agreements on that subject. If a provision is unenforceable, it will be enforced to the maximum extent permitted and severed as necessary, without affecting the rest, except as specifically stated in Section 20. Our failure to enforce a provision is not a waiver. Section headings are for convenience only.
You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law. No person other than the parties has a right to enforce these Terms, except the parties protected by Sections 17 through 19. Nothing creates an agency, partnership, joint venture, employment, or franchise relationship.
